Not being a pharmacist, and notwithstanding

the fact that he was not qualified to sell "specified" drugs sold two tins (each containing 700 grammes) of

"specified" drugs of diacetyle morphine hydrochloride to

Min Tai Yu in the neighbourhood of the Gas Building at

4 chome, Hiranomachi, Higashiku, Osaka about February

2nd, 1938.

The defendant Mantaro Asada;

(1) In selling anaesthetics to Toshio Shibata knew

that he was about to export anaesthetics to China without

having obtained a permit from the Home Minister, and sold 47 tins (each containing 700 grammes) of anaesthetic

diacetyle morphine hydrochloride and 8 tins (each containing 450 grammes) of morphine hydrochloride to Toshio Shibata

in the neighbourhood of the aforementioned Gas Building

on nine occasions during the period from about March 14th,

1938, to May 11th, 1938, thereby assisting and facilitating the offence of smuggling anaesthetics committed by

Toshio Shibata as stated in No. 1 (1).

(2) Not being a pharmacist and notwithstanding the fact that he was not qualified to sell "specified" drugs sold 42 tins (each containing 700 grammes) of "specified" diacetyle morphine hydrochloride, 100 bottles (each containing 5 grammes) of a "specified" drug, morphine hydrochloride, and 17 tins (each containing 700 grammes)

of cocaine hydrochloride to the aforementioned Toshio

Shibata and one Harada in the neighbourhood of the Osaka Station (Government lines) on ten occasions during the period from about October 9th, 1937, to July 9, 1938.
